These Terms of Service govern your use of the services provided by QBIK HOST LLC, a Wyoming limited liability company ("Qbik Host", "we", "us"). Qbik Host offers its services to customers internationally. By creating an account or using any of our services, you agree to be bound by these Terms, together with our Acceptable Use Policy, Privacy Policy, and Refund Policy.
Qbik Host provides shared web hosting, domain registration through our registrar partner, custom web design, security monitoring, and related advisory services. The specific features included in your plan are listed on the plan's page at checkout and in your client area.
You must be at least 18, or the age of legal majority where you live, to purchase a service. You're responsible for keeping your account information accurate and your login credentials secure, and for all activity that happens under your account. If you're accepting these Terms on behalf of a business, you confirm you have the authority to do so.
Plans are billed in advance for the term you choose at checkout. By subscribing, you authorize us to charge your payment method automatically on each renewal date, at the then-current price, until you cancel — we'll email you a reminder at least 7 days before a renewal. You can cancel any time from your client area (Services → Request Cancellation); cancellation stops future billing and takes effect at the end of your current term unless you choose immediate cancellation. Prices are shown in USD; any applicable taxes are your responsibility. We may change pricing with at least 30 days' notice, and any change only applies to your next renewal, never your current term. Unpaid invoices may lead to suspension and, after a grace period, account termination and data deletion.
Refund eligibility is set out in our Refund Policy. In short: new hosting plans are refundable within 14 days of purchase, renewals aren't refundable, and domain registrations and similar add-ons aren't refundable once we've provisioned them.
Your use of the services is subject to our Acceptable Use Policy. Violating it can lead to suspension or termination without a refund, and you're solely responsible for any content you store or transmit through your account.
Each plan has its own storage, bandwidth, and performance limits, listed at the time you order. If your usage is high enough to affect other customers on shared infrastructure, we may throttle the responsible process, ask you to upgrade, or in persistent cases suspend the account. Terms like \u201cunlimited\u201d describe typical small-business website usage, not a license to use your hosting as bulk file storage or a media server.
Where backups are included in your plan, we provide them as a courtesy, not a guarantee — we don't promise that a given backup will be available, complete, or restorable. You're responsible for keeping your own independent backups of anything you can't afford to lose.
We target 99.9% uptime per calendar month, excluding scheduled maintenance and events outside our reasonable control. We don't currently offer automatic service credits for downtime unless agreed separately in writing.
You keep all rights to the content you upload. You grant us a limited license to host, transmit, and back up that content solely to provide the services. We don't access your content except as needed to deliver, maintain, or troubleshoot the service, or where the law requires it.
We may suspend or terminate your account, with or without notice, if you violate these Terms, the Acceptable Use Policy, applicable law, or if your account creates risk for us, other customers, or third parties — and for non-payment, after we've given you notice. If you cancel, it takes effect at the end of your current billing term unless you request an earlier date.
The services are provided \u201cas is\u201d and \u201cas available\u201d, without warranties of any kind — including that they'll be uninterrupted, error-free, or fit for a particular purpose. Where local law doesn't allow excluding certain warranties, our warranties are limited to the minimum the law requires.
Except where liability can't legally be limited — including for gross negligence, willful misconduct, fraud, or death or personal injury — our total liability for any claim related to the services is limited to the greater of USD 100 or what you paid us in the 12 months before the claim. We're not liable for indirect, incidental, or consequential damages, or for lost profits, data, or goodwill.
You agree to defend and hold us harmless from claims arising from your use of the services, your content, your violation of these Terms or the Acceptable Use Policy, or your violation of someone else's rights. We'll let you know promptly about any such claim and allow you to handle the defense, provided any settlement doesn't impose obligations on us without our consent.
Neither of us is responsible for delays or failures caused by events reasonably outside our control — natural disasters, war, civil unrest, government action, power or network outages, denial-of-service attacks, or failures at upstream providers we depend on.
QBIK HOST LLC is a Wyoming company, and our services are subject to United States export control and sanctions laws regardless of where you're located. By using our services, you confirm that you're not located in, and not ordinarily resident in, any country or region subject to a comprehensive U.S. embargo, and that you're not on any U.S. government list of restricted or prohibited parties. You're also responsible for complying with whatever additional laws apply to you and your content in your own country. We may decline or suspend service where we reasonably believe providing it would violate applicable law.
We take copyright seriously. If you believe content hosted with us infringes your copyright, follow the notice process described in our Acceptable Use Policy. We act promptly on valid notices and terminate the accounts of repeat infringers.
Before filing a formal claim, please contact us at hello@qbik.host and give us at least 30 days to resolve the issue informally — most things get sorted out this way. If that doesn't work, you and Qbik Host agree that any dispute arising from these Terms or the services will be resolved through binding, individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules, rather than in court, except that either of us may bring an individual claim in small-claims court instead. Arbitration will take place in Wyoming or by videoconference, at your choice, and you and Qbik Host both waive the right to a jury trial and to bring or join a class, collective, or representative action — each dispute is handled individually. You can opt out of this arbitration agreement by emailing hello@qbik.host within 30 days of first accepting these Terms; if you do, this section doesn't apply to you, though the rest of these Terms still do. These Terms and any dispute not subject to arbitration are governed by the laws of the State of Wyoming, USA, without regard to conflict-of-laws rules, and the Wyoming state and federal courts have exclusive jurisdiction over anything not arbitrated.
Notices to us should go to hello@qbik.host. Notices to you will be sent to the email address on your account, and are treated as received on the date we send them.
Sections covering billing for services already provided, your content license to us, disclaimers, limitation of liability, indemnification, and dispute resolution remain in effect even after these Terms end.
You can't transfer these Terms to someone else without our written consent. We may transfer them as part of a merger, acquisition, or sale of the business.
These Terms, together with our Acceptable Use Policy, Privacy Policy, Refund Policy, and any order details, make up the whole agreement between us about the services. If one part of these Terms turns out to be unenforceable, the rest still applies. If we don't enforce a right immediately, that doesn't mean we've given it up.
Parts of our service rely on third-party providers — including OpenProvider for domain registration, Stripe for payment processing, and Blesta for billing and account management. Your use of the services is also subject to those providers' own applicable terms.
We may update these Terms from time to time. We'll announce material changes through your client area or by email at least 30 days before they take effect. Continuing to use the services after that date means you accept the update.
